These Terms of Service ("Terms") govern your use of the website, web app, and services (together or individually, "Service") offered by Kohbee Technologies Pvt Ltd. ("Kohbee", "we", "our", "us", "Company"). "You", “Seller” refers to you as a user of the Service.
Your privacy is important to us. Our Privacy Policy explains how we collect, safeguard, and disclose information that results from your use of our Service, and also governs your use of our Service. Please read it here: https://kohbee.com/privacy-policy
Please read these terms carefully. By using our Service, or otherwise indicating your acceptance, you represent and warrant that you have read, understand, and agree to be bound by these Terms. If you do not agree, please do not access or use our Service.

Account Terms
No Use by Minors Under 16
Our Service is intended only for access and use by individuals at least sixteen (16) years old. By accessing or using any of Kohbee, you warrant and represent that you are at least sixteen (16) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. If you are not at least sixteen (16) years old, you are prohibited from both access and usage of Service.
Account Creation
When you create an account with us, you guarantee that you are above the age of 16, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar, or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
Communications
By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing us at privacy@kohbee.com.
Prohibited Uses
You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:
(a) In any way that violates any applicable national or international law or regulation.
(b) For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
(c) To transmit, or procure the sending of, any advertising or promotional material, including any junk mail , chain letter, spam, or any other similar solicitation.
(d) To impersonate or attempt to impersonate Kohbee, a Kohbee employee, another user, or any other person or entity.
(e) In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
(f) To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Service, or which, as determined by us, may harm or offend Kohbee or users of Service or expose them to liability.
Additionally, you agree not to:
(a) Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party's use of Service, including their ability to engage in real-time activities through Service.
(b) Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
(c) Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.
(d) Use any device, software, or routine that interferes with the proper working of Service.
(e) Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
(f) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.
(g) Attack Service via a denial-of-service attack or a distributed denial-of-service attack.
(h) Take any action that may damage or falsify Company ratings.
(i) Otherwise attempt to interfere with the proper working of Service.
Fees and Payment
Pricing, Payments, and Refunds
Platform Pricing and Payment: Kohbee may charge fees from sellers to access particular features and functionalities of the Platform (“Kohbee's Fee”/ “Fee(s)”)through multi-tiered paid plans as described on our Pricing Page (“Subscription”/“Subscription Plan”). Please read the below terms applicable for the purchase of your Subscription:
We offer various types of Subscription Plans, and Kohbee’s Fee structure for each Subscription Plan differs. Please go through the details provided on our Pricing Page carefully before making any purchase.
Our billing cycles depend on the Subscription Plan you select while purchasing. Payment will be charged to your chosen payment method at confirmation of your purchase in accordance with the billing cycle applicable for your Subscription Plan.
We may use third-party service provider(s) to manage all our Subscriptions, including their purchases, renewals, cancellations, and invoicing (“Subscription Manager(s)”). Accordingly, we may not collect any payment related information such as credit/debit card details, UPIs, and bank account details from you, and all such Sensitive Personal Data, in such cases, shall be collected and processed by such Subscription Manager(s). Subject to your authorization and applicable laws, You agree that Kohbee may, if applicable, as per your chosen Subscription Plan, charge any recurring service to the credit card or debit card that you provide at the time of your first purchase of the Subscription through the Subscription Manager(s) or as updated by you through the Subscription Manager(s), provided such updation takes place prior to upcoming billing period, as applicable.
You agree to pay all fees and charges that are made to your account and that you are solely responsible for payment of these fees and charges. If you have not completed payments for your Subscriptions, we may restrict your access to the Platform until your account becomes current and paid in full.
Your payments to Kohbee shall be subject to applicable taxes including without limitation Goods and Service Taxes (GST) and Value Added Taxes (VAT) or other similar taxes as may be applicable in your country of residence/from where you have created your account on the Platform/ purchased the underlying Subscriptions.
We reserve the right to pursue fees owed to us using collection methods which may include charging other payment methods on file with us and/or retaining collection agencies or legal counsel.

We reserve the right to change/revise the pricing of the Subscriptions. For existing Subscriptions for which the applicable fees have been already received by us, we will implement the price changes during the next billing period or renewal of the Subscription.
We further reserve the right to offer custom plans and pricing in addition to what is offered on the Pricing Page, which include offering custom billing and payment terms, that are different from our standard terms.
We have also enabled integration of third-party payment providers to facilitate better payment options to you, which may vary depending on your territory or the Subscription you choose (“Third-Party Payment Providers”). Third-Party Payment Providers may also charge you fees to use or access their services and may require your Personal Data to complete any transaction for the Platform. Further, to facilitate completion of your payments to us through the Platform or avail the payment options provided to you, you may be redirected to an external website operated by the Third-Party Payment Provider(s).
Further, pursuant to the payment option you may choose, you may be required to enter into a separate agreement with the relevant Third-Party Payment Provider. This agreement with the Third-Party Payment Provider is an independent contract/agreement between you and such Third-Party Payment Provider and Kohbee shall in no manner be a party to the same. Kohbee only facilitates various payment options to you and is not offering the payment by itself in any manner.
You agree that you are solely responsible for all charges that occur through such Third-Party Payment Providers and acknowledge and agree to indemnify, defend, and hold harmless Kohbee, its licensors, their affiliates, and their respective officers, directors, employees, and agents from any loss arising out of or related to the use of the Platform or any purchases made through the Platform. This obligation will survive your use of the Platform and termination of your Agreement with us.
Kohbee cannot and does not (i) guarantee the adequacy of the privacy and security practices employed by or the content and media provided by the Third-Party Service Providers or its respective websites or (ii) control collection or use of your Personal Data by such Third-Party Service Providers. Hence, prior to using any services offered by a Third-Party Service Providers, we suggest that you read their terms and conditions, privacy policy and other policies, that may apply, to understand their terms of usage and to understand how your Personal Data is being processed. Kohbee is not affiliated to any Third-Party Service Provider and neither Kohbee nor any of the Third-Party Service Providers are agents or employees of the other.
For the purpose of the Platform Terms
“Third-Party Service Providers” shall mean and include Subscription Manager(s), Third-Party Payment Providers, and any third-party payment gateways and/or aggregators used to collect payments of Kohbee's Fee or used by the sellers to collect their seller Fee(s) or such other payments from their End- Users.
“Loss” means all losses, liabilities, damages, awards, settlements, claims, suits, proceedings, costs, and expenses (including reasonable legal fees and disbursements and costs of investigation, litigation, settlement, judgment, interest, and penalties). Kohbee shall not be liable to you for any claims arising out of any act or omission on the part of the Third-Party Service Provider(s) including, but not limited to, any lost, stolen, or incorrectly processed payments. Kohbee expressly disclaims any responsibility and liability for all services provided by the Third-Party Service Provider(s).
Please note that all Fee(s) payments are collected by Kohbee only through the Platform and not through any third parties (except Third-Party Service Provider(s)). We do not usually authorize any third party (except Third-Party Service Provider(s)) to collect monies on our behalf; however, if we have authorized any third party then such third party will have received a written authorization from Kohbee either by way of any agreement or an authorization letter. Kindly verify with such a third party before you make any payments to them, alternatively, you can always check with us by writing to us at hello@kohbee.com
Further, Kohbee is solely authorized to offer discounts / offers, if any, on Kohbee's Fee. These discounts / offers are communicated on the Platform or via direct communication to you from Kohbee via email, SMS, phone, or such other means of communication, and can be availed only through the Platform, unless otherwise specifically communicated by Kohbee. Other than Kohbee, no person is allowed to offer any discounts on Kohbee's Fee offered on the Platform. Kohbee shall not be liable for any claims arising from such unauthorized discounts / offers offered by any person (including any third-party platform), other than Kohbee.
Cancellation and Refund Policy
You may cancel your Subscription by either writing to us at hello@kohbee.com or through your account on the Platform. However, please note there shall be no refund of the Fee already paid for your Subscription, unless otherwise specified in the Refund Policy. So, please read these Terms of Service and the Refund Policy carefully before subscribing to any of the Subscriptions.
When you cancel your Subscription, Kohbee may disable access to features available only to sellers who have purchased/renewed Subscription, while your account may continue to exist on the Platform.
Payments w.r.t seller's Fee
The seller's Fee for the Content/services made available on the sellers' Page is solely determined by the respective sellers, and Kohbee has no role in determining the same. The seller must make available to their End-Users the terms and conditions in relation to the enrolment, use of Content and related services that may be provided by the seller on their Page(s).
With an intent to have a more user-friendly transaction model for payment of the seller's Fee, we allow sellers to integrate various third-party payment aggregators to process payments for products, services, or other content purchased through the seller's Page (“Third-Party Payment Aggregators”)by End Users. Third-Party Payment Aggregators made available to you may vary depending on your territory. Once selected, the Third-Party Payment Aggregator(s) may need you to create an account on their platform or provide the information of your existing account(s) with them and agree to such Third-Party Payment Aggregator's terms and conditions and privacy policy. Once you have enabled payments on the Platform and registered with the Third- Party Payment Aggregator(s) as stated above, you will see that they are responsible for directing and distributing payments for services purchased through your Page, including automatically sending receipts to your End-Users and directing payouts to you and any bank accounts identified by you. The Third-Party Payment Aggregator(s) will collect the amounts paid by your End-Users and remit the collected amounts to you after deduction of their fee, if any, and applicable taxes. Please note Third-Party Payment Aggregators may also charge you fees to use or access their services and may require your personal data to complete any transaction for the Platform. Hence, prior to using any services offered by a Third-Party Payment Aggregators, we suggest that you read their terms and conditions, privacy policy and other policies, that may apply, to understand their terms of usage and to understand how your data is being processed; this is also because, when you use the services or platform offered by such Third-Party Payment Aggregator, you agree to their respective terms and policies. Kohbee is not affiliated with their Third- Party Payment Aggregators and neither Kohbee nor any of the Third-Party Payment Aggregators are agents or employees of the other.
Further, if you have purchased a Subscription Plan that requires you to share your revenue with Kohbee, then your seller's Fee may be paid to you by the Third-Party Payment Aggregators after deducting Kohbee's share, as agreed and applicable. Please read the Pricing Page and other terms, if any, specified on the Platform in this regard.
Please note: You may not bypass or circumvent the payment mechanism offered by the Platform by soliciting payment from an End-User outside the Platform in any manner including by using any alternative method to collect the seller Fee and/or fee/monies for any service offered by the seller on the Platform such as receiving payments through links to digital wallet platforms like Google Pay, Paypal or such other online payment system or electronic wallets.
Further, please note the below terms:
In respect of your transaction, you are solely responsible for all applicable Goods and Services Taxes ('GST'), EU Value Added Taxes ('VAT'), or other similar taxes as may be applicable in your country of residence, costs, filings, and any other activities that may arise as a result of sales of your Content / services using the Platform. Neither is Kohbee responsible to nor does it collect, pay, remit or otherwise pay on your behalf, the taxes owed by you (including GST or EU VAT) on the services you sell through your Page.
You set the seller's Fee of each service offered by you through your Page at your sole discretion and without any input from Kohbee.
All invoices made to your End-Users through the respective Third-Party Payment Aggregator shall indicate that you are the supplier of the services offered by you on through your Page.
End-Users' invoices shall identify the name and nature of the services offered by you that was purchased.
As stated, payments in respect of your services offered by you through your Page are processed by Third-Party Payment Aggregators, hence, neither is Kohbee a party to the authorization process nor is Kohbee responsible for authorizing credit card charges through such Third-Party Payment Aggregators.
You are responsible for making available the terms and conditions, privacy policy and refund policy applicable for your Page. It is further agreed by you that you shall indemnify, defend, and hold harmless Kohbee and its directors, officers, agents, employees, successors, assignees, agents and authorized representatives against any loss of credit, tax, interest and/or penalty resulting from your failure to refund seller's Fee in accordance with your policies, remit the applicable taxes to the respective authority within the stipulated time period, or your failure to otherwise conform to applicable laws.
Should there be any issues with payments, Kohbee has no responsibility to accept or reject any services offered by you through your Page. You agree that once payments are processed through a Third-Party Payment Aggregators, such processing serves as an authorization to Kohbee to deliver the services to your End-Users through the Services.
You hereby agree and accept that in respect of any transaction, applicable taxes (direct and/or indirect) shall be deducted from the payment. You shall solely be liable for all your taxes (including service and withholding taxes) within and/or outside India. It is further agreed by you that you shall indemnify, defend, and hold harmless Kohbee and our directors, officers, agents, employees, successors, assignees, and authorized representatives against any loss of credit, tax, interest and/or penalty resulting from your failure to remit the applicable taxes to the respective authority within the stipulated time period, or your failure to otherwise conform to the applicable laws.
Customized Subscription & Service Order
To provide sellers with customized solutions and access to certain services and features of our Platform, Kohbee may offer customized Subscriptions to sellers who make such a request, and Kohbee's Fee applicable for such Subscriptions shall be dependent on the Services or features offered thereunder. To create and access an account under a customized Subscription, you must execute our service order(“Service Order”) and pay the applicable Kohbee's Fee in accordance with the terms of such Service Order. In the event of any conflict or inconsistency of the terms between the Service Order and any other provisions of these Platform Terms, then only to the extent of such conflict or inconsistency, the terms of the Service Order shall prevail.
Subject to execution of the Service Order, we will: (a) make the Services available to you in accordance with the applicable Service Order, and (b) host, serve and support the Services in accordance with our service levels, if any, agreed in the respective Service Order.
We reserve the right to modify or change the Services offered to you at any time, provided that the modification or change (a) will be duly notified to you, (a) will not result in a material degradation or material loss of functionality of the Services; or (b) will not change the service levels provided in the Service Order except as permitted by this section.
Free Trial
Kohbee Technologies Pvt Ltd. may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
You may be required to enter your billing information in order to sign up for a Free Trial.
If you do enter your billing information when signing up for a Free Trial, you will not be charged by Kohbee Technologies Pvt Ltd. until the Free Trial has expired. On the last day of a Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, Kohbee Technologies Pvt Ltd. reserves the right to (i) modify Terms of Service of the Free Trial offer, or (ii) cancel such Free Trial offer.
Fee Changes
Kohbee Technologies Pvt Ltd., in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Kohbee Technologies Pvt Ltd. will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Refunds
Except when required by law, paid Subscription fees are non-refundable.
Content Policy
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.
By posting Content on or through Service, you represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on any of these rights.
You retain any and all of your rights to any Content you submit, post, or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. However, by posting Content using Service you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through Service. You agree that this license includes the right for us to make your Content available to other users of Service, who may also use your Content subject to these Terms.
Kohbee Technologies Pvt Ltd. has the right but not the obligation to monitor, edit, and remove all Content provided by users. It is your responsibility to exercise judgment when posting content on the Service. The following types of content are not allowed:
- Nudity and sexually explicit content
- Violent, dangerous, or graphic content
- Hate speech
- Harassment and cyberbullying
In addition, Content found on or through this Service are the property of Kohbee Technologies Pvt Ltd. or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
Referrals Terms
The Kohbee referral program ("Referrals") allows users to get paid for new users they refer to Kohbee. To participate, users must agree to these terms. The specific terms of each referral, including commission rate, promotional credits, and others, may vary.
How to Earn Commissions
Referrers get paid a commission on subscription payments for up to 12 months for every customer they refer to Kohbee. A customer is considered to have been referred by a user if they buy a product built by Kohbee via referral link and continue to be tracked through account creation. Unless the new user is tracked automatically through software, they will not be considered to have been referred.
The referring user will earn a percentage of subscription payments, no higher than 40%, each time a payment is received by Kohbee. Referral commissions will not be earned when referred users on paid plans are using Kohbee credits, or in any other situation where no payment is received by Kohbee.
We reserve the right to amend the commission rate for any user at any time, in our sole discretion without notice.
Sharing Referral Links
Referrals should only be used for personal and non-commercial purposes. Referral links should not be published or distributed on commercial websites (such as coupon websites, Reddit, or Wikipedia) or on blogs. Users are prohibited from “spamming” anyone with referral invitations. This includes mass emailing, texting or messaging people you do not know or using automated systems or bots through any channel to distribute your referral link. Members are prohibited from paying to advertise their referral links.
Referred Users
Referred users may receive a promotional credit ("Credit(s)") not exceeding $100 in Kohbee credit, depending on the specified terms of the referral offer. Kohbee reserves the right to amend or remove the credit for any user at any time, in our sole discretion without notice.
A referred user may only use one referral link. If a referred user receives referral links from multiple Kohbee users, only the Kohbee user associated with the referral link actually used by the referred user will be eligible for commissions.
Severability
If any provision in these terms are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.
Termination and Changes
Kohbee may suspend or terminate Referrals or a user’s ability to participate in it at any time for any reason.
We reserve the right to suspend accounts or remove Credits if we notice any activity that we believe is abusive, fraudulent, or in violation of the Kohbee Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate.
The scope, variety, and type of services and products that you may obtain by redeeming Credits can change at any time.
Updates to the Referrals Terms
We can update these terms at any time without prior notice. Continued participation in the Referrals program after any modification shall constitute consent to such modification.
Intellectual Property
Infringement Policy
We respect the intellectual property rights of others, and we ask our users to do the same. It is our policy to promptly process and investigate notices of alleged infringement, including claims that Content posted on the Service infringes the intellectual property rights of others, and we will take appropriate actions under the Digital Millennium Copyright Act, the Copyright Act, and other applicable intellectual property laws with respect to any alleged or actual infringement.
When we remove or disable access in response to a notice, we will make a reasonable attempt to contact the affected member, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about how to submit a counter-notice. We may also provide a copy of the infringement notice, including the name and email address of the reporting party, to the affected member.
If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have otherwise been violated, please submit your claim via email to privacy@kohbee.com to our Copyright Agent with the following information:
(a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
(b) a description of the copyrighted work or other intellectual property that you claim has been infringed;
(c) a description of where the material you claim is infringing is located on the Service, including identification of the URL, and with enough detail that we may find it on the Service;
(d) your address, telephone number, and email address;
(e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and
(f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
We may request additional information before processing a notice, such as identity verification of the reporting party or documentation regarding the claimed right. We may reject notices that contain information we believe is false, fraudulent, incomplete, or otherwise submitted in bad faith and reserve the right to act against abusers of this policy.
We accept counter-notices for copyright notices only. If you have a good faith belief that content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content, you may send a written counter-notice containing the following information to the Copyright Agent:
(a) your physical or electronic signature;
(b) identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
(c) a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
(d) your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court located within the Northern District of California and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If the Copyright Agent receives a counter-notice, we will send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims made regarding infringement or non-infringement of any Content found on and/or through Service. If you are not sure whether the Content is infringing, please contact an attorney before submitting a notice or counter-notice. Fraudulent or abusive notices or other misuses of our Infringement Policy may result in account termination or other legal consequences. Per the Termination section of these Terms, we reserve the right to terminate or suspend user accounts at any time, for any reason, and without prior notice.
Third-Party Services
Analytics
We may use third-party Service Providers to monitor and analyze the use of our Service.
Google Analytics
